Avoiding Social Media After a DU

Social media plays a significant role in the daily lives of both adults and teenagers. However, that doesn’t mean you should share every detail of your life on platforms like Facebook, Twitter, or Instagram. This is especially important to consider if you face a legal issue, such as being arrested. If you’ve been charged with driving under the influence, posting about the situation on social media could jeopardize your defense.
Your social media account settings limit post visibility to only your friends. However, the reality is that when a crime is involved, much more can be uncovered. Law enforcement and prosecutors have the authority to subpoena records from social media platforms and cell phone carriers if they suspect there is incriminating evidence related to your social media activity. In some cases, even friends of friends may come across posts that you never intended for them to see. Therefore, it is unwise to assume that your social circle is impenetrable or that your posts about a DUI—or any other matter—are restricted to a select audience.
A woman from Michigan learned the hard way how sharing details about legal matters on social media can have serious consequences. Colleen Cudney was on probation for a DUI she received in 2012. The day before posting, she violated her probation by drinking on St. Patrick’s Day, yet she was able to pass a breathalyzer test. However, her situation changed when she decided to post about her luck on Facebook. An officer saw the post, and as a result, Cudney now faced an additional 93 days in jail because she effectively admitted guilt in a public forum.
It is always best to avoid posting about your DUI, arrest, or any accidents you may have been involved in, especially avoiding any admission of guilt. If you've been arrested for a DUI, you must avoid posting about the incident on social media. Also, you'll need to consult an experienced lawyer who can help protect your rights under the law. It's essential to explore a solid defense strategy to effectively challenge the charges against you.
